Permanent Rules
Our proposed permanent rules were presented to the WSU Regents on September 21, 2018, and adopted as the permanent rules. They are available on the Washington State Legislature website: Chapter 504-49 WAC)
Public Hearing
A public hearing on the proposed permanent rules was held on August 23, 2018, at seven locations across the state. Written comments were accepted until 5:00 p.m. on August 23, 2018.
Timeline
- July 18, 2018 – Supplementary proposal and revised final wording of the permanent rules were filed with the state by noon.
- August 1, 2018 – Supplementary proposal and final wording were published in Washington State Registry.
- August 23, 2018 – Public comments accepted through 5 p.m.
- August 23, 2018 – Hearing on supplemental proposal and revised final wording.
- September 21, 2018 – Final rules submitted for approval to the WSU Regents.
- October 26, 2018 – Permanent rules became effective.
Background
A new renewable energy incentive program for citizens and businesses of Washington passed the Washington State Legislature and was signed into law by the Governor in July 2017. Engrossed Substitute Senate Bill 5939
Emergency Rules
Previously, WSU filed for an extension of the emergency rule so it would remain in effect through June 26, 2018. The draft of the final rule is available at the Code Reviser's Office Washington State Register website: http://lawfilesext.leg.wa.gov/law/wsr/2018/06/18-06-099.htm
Proposed changes to the emergency rule are located in Sections 165 and 195 of the proposed final rule. Public comment on the final rule was accepted from March 21 until April 12, 2018. A public hearing on the final rule was held on April 12, 2018, at several locations across the state.
Updated emergency rules were refiled on May 31, 2018, and are effective until September 28, 2018. Public comments were invited; applicable comments were addressed in the proposed permanent rules.
